We will refer to the House of Raige LLC, Its website and our services collectively as House of Raige “the Site”, “We”, “Us”, “Our”. Please read through these terms and conditions carefully. These terms and conditions of service (referred to simply as “Terms”) govern your access and use of www.houseofraige.com and our services. By accessing, visiting and/or using our Site and services you agree to be bound by these terms and our privacy policy.

BY USING THIS SITE, WETHER OR NOT YOU HAVE REGISTERED FOR AN ACCOUNT, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS, PLEASE EXIT THE SITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THIS SITE, PRODUCTS OR TERMS IS TO CEASE USING THIS SITE AND/OR THOSE PARTICULAR PRODUCTS.

1. Right to make changes to terms

We reserve the right to change these Terms at any time, with or without notice. You acknowledge and agree that it is your responsibility to periodically review these terms before using our Site. Your use of the site after any such changes have been made will constitute your acknowledgement and acceptance of these terms. Notice of any updates may be sent to the email address on file, it is your responsibility to keep your email current to receive notice of any changes.

2. Site Availability

This Site is available to you on a temporary basis. We reserve the right to restrict access and/or make changes to our site at any time, for any reason and without notice. During such time, the Site, or parts of the Site, may be unavailable for any amount of time.

3. Your Account – Registration and Privacy

Using the Site and creating an account is purely optional, However, in order to create an account and use certain features of our website, you may be required to provide certain personal information. That information may include your name, postal address, email address, and payment information. When you elect to give us your personal information you agree to provide only accurate and complete information. It is your responsibility to keep your account current and accurate at all times. Failure to do so may result in suspension or termination of your account.

While using our site it is imperative that you maintain the security of your login information and any other account information you have provided to us. We are not liable or responsible for any purchases, changes or damages made to your account by your child, friend, spouse, relative or any other entity that assumed control of your account from any device you are currently logged into or have previously been logged into. If you believe your account has been compromised for any reason, we advise you to contact us and change your password immediately. We are not liable for any purchases, changes or damages made to your account prior to you contacting us about an account breach. However, we may be able to prevent any further action from taking place under your account.

The House of Raige provides an automated user account system. We do not know or keep a record of your account password. In the event you lose or forget your account password you will need to reset it following the prompts on our login page. The House of Raige, its employees and affiliates will never ask for your password.

4. Your orders – Terms of sale, Payment, Billing and Sales Tax

By placing an order, you understand and agree to be bound by the following

All products are subject to availability. When you place an order, you will receive a confirmation email that your order was received. This email is only acknowledgement of your order and does not constitute acceptance of your order. We reserve the right to place a hold or cancel any order up until the point of delivery. We may need to impose limits on any order or number of products within an order, either on a per-person or per-household basis. If we reject, limit, or hold any order, we will attempt to notify you with the email you have on file with us. If we cancel an order or part of an order, you have already been charged for, the cancelled portion of the order will be refunded in full.

When you place an order, you will need a valid method of payment that is accepted on our site. You may be asked to provide information relating to your transaction including, but not limited to, your card number, expiration date, shipping address and billing address. By submitting this information, you grant us the authority to provide any necessary information to third parties for the purpose of facilitating the transaction and completion of your order.

You may only submit a valid method of payment that you have full legal authorization to use. You acknowledge and agree that you will not use any method of payment if you do not have legal authorization to do so. We reserve the right to change or suspend our payment options for any reason, at any time, for any amount of time.

4a. Sales Tax are not included in the listed price of our products. We have an automated system that charges the necessary sales tax based on your shipping address. We will automatically charge and withhold the necessary sales tax for orders delivered within the USA, determined by our order policy in effect at the time of purchase.

4b. Pre-Authorization Upon receiving your order, our system will run a pre-authorization check on your method of payment to verify there are sufficient funds available to fulfil the order. Orders will not be dispatched until the pre-authorization has been verified and completed.

4c. Reshipping Orders that are returned to us from inaccurate shipping information or failure to collect, will require a new shipping label to be purchased. If you choose not to repurchase shipping you will be forfeiting your order. You will have fourteen (14) days from the day your order is returned to us to pay for reshipping or risk forfeiting your order. You will be notified of the day your order was returned to us Via your email on file. You understand that you are responsible for providing accurate shipping information and the House of Raige is not required to reship your order should you refuse to pay for reshipping.

4d. Preorders, Back orders, Made-to-Order Any product on our site may be available for preorder, back order, or made to order.  will be sent out once the product is available and ready to be shipped. The processing time and shipping date will be listed with the product. HOWEVER, we reserve the right to adjust the availability dates on our preorders, back orders and made-to-orders as we deem necessary and within reason. Your payment method will be charged upon placing your preorder, back order and made-to-order.

5. User guidelines, limitations, and Termination

You may not use this website if you are under the age of 13. If you are between the ages of 13-18 you may only use this site while supervised by a parent or guardian.

You must not misuse this website. Your use of the Site is subject to all applicable laws and regulations. By posting or communicating with Us and the Site you agree to the following

5a. You will not use language with the users, employees, or affiliates of the House of Raige that is threatening, derogatory, defamatory, or abusive for any reason. Whether that be through our Site, email, social media, or any other form of communication.

5b. You will not solicit or send any violent, graphic, or sexually explicit content to the users of the House of Raige, its employees or affiliates.

5c. You will not infringe on any of the Site’s trademarks, copyrights, or other proprietary information.

5d. You will not use or upload any malicious code, files or programs that may disrupt or damage the functionality and validity of the Site.

5e. You will not attempt to breach the security of the Site, any of its servers, domains, or emails.

5f. You will not impersonate another person, including another user, our employees, or affiliates.

House of Raige reserves the right to suspend or terminate your account in our sole discretion without warning and without liability.

6. Third Party Links/ Linking to this Site

Our Site may contain links to websites that are not necessarily affiliated with the House of Raige. We are not responsible for the content or privacy practices of other such sites. We encourage our users to be aware when they leave our Site and to read the policies provided by any site that collects personally identifiable information. The House of Raige provides these links as a convenience and does not necessarily endorse the linked site, nor does it imply an affiliation with those sites

House of Raige grants you revocable permission to link to our site. If you choose to link to our Site, you agree to be bound by the following Terms.

6a. You may ONLY link to our Home Page.

6b. The site must be owned by you.

6c. You may not link to our site if your site has distasteful, defamatory, derogatory, offensive, hateful, or violent graphic content. You understand that these are decided at the sole discretion of House of Raige.

6d. You may not link to our Site and imply we have endorsed, approved, or are otherwise affiliated with you, your site, or your products/ Services. If one of our employees, or affiliates has expressed their own opinions about you or your site, it is not to be construed as the opinion of the House of Raige LLC.

6e. Your site cannot use any of our trademarks, copyrights, or intellectual properties.

It is your responsibility that your site is maintained under these terms if you wish to continue linking to our site. We reserve the right, in our sole discretion, to withdraw permission to link at any time and without warning.  

7. Intellectual Property/Copyright infringement

Our Intellectual Property Intellectual properties such as graphics, logos, text, images, video, audio, software, and other media available withing the Site will be referred to as “Content”. The Content provided in this Site is the property of House of Raige and/or its affiliates and protected by copyright law. You are granted a non-exclusive and non-transferrable license to access and use www.houseofraige.com and its content. As a condition of your use of this Site you acknowledge and agree that you will not use the Site for any unlawful or prohibited purpose.

You may store, print, and display content provided on this Site solely for your personal use. You will not publish, modify, distribute, reproduce, sell, or exploit the content made available to you nor will you use this content for any commercial business.

Copyright Infringement Our core values are to honor the creativity and work of designers and artists. We would not knowingly infringe on the work of any such artist, individual or entity.

If you reasonably believe that your work has been infringed upon, you may submit a notice to House of Raige so we may begin a process of resolution. Prior to sending notice you may wish to consult with a lawyer to determine your rights and legal obligations. Nothing here or anywhere on our site is intended to be legal advice. To begin our resolution process, we request that you provide:

7a. The name and contact information of the person, or entity whose work has been infringed upon and their signature.

7b. Details that will allow us to locate the work or collection of work believed to have been infringed upon.

7c. A statement from the complaining person or entity that sums up their intellectual property and the rights they hold to that property.

7d. Provide any additional information regarding a record and history of the work in question.

7e. A Statement, under penalty of perjury, that any and all information in the notice is true and correct.

No submitted complaints will be without question, and it will involve all necessary communication to arrive at a resolution. You understand that we may request additional information and consultation with legal representation before we decide to remove any work in question.

Intellectual property confidentiality Please do not submit any confidential information to Us, including ideas, content suggestions, or business proposals. Communications sent by you to us will be treated as non-confidential and non-proprietary. Ideas that we receive unsolicited will become property of the House of Raige and will not be returned to you.

8. Indemnification

You agree to indemnify and hold harmless House of Raige, its Directors, employees and affiliates for any losses, costs, or expenses (including but not limited to, legal fees) Arising from your use or misuse of the Site or your breach of the Terms of Service.

9. Severability, Savings, No Waiver

If any part of these terms is deemed invalid or unenforceable, that portion shall be construed in a manner most consistent with applicable law to reflect the original intention. When necessary, any portion of these terms that is unenforceable shall be severable, and the rest of these terms shall remain intact. If you breach these terms and we take no action, that does not constitute a waiver and does not limit our rights to act on any subsequent breaches of these terms.

10. Force Majeure

There are some extraordinary circumstances that would render the House of Raige unable to fulfill its duties and obligations. Such failure to perform occurs by reason of any of the following “Force Majeure” events: act of God, pandemic, epidemic, fire, flood, storm, earthquake, tidal wave, communications failure, war, military operation, terrorist attack, national emergency, mechanical or electrical breakdown, general failure of the postal or banking system, civil commotion, request, or recommendation of any governmental agency or acting governmental authority. Within these circumstances the House of Raige is excused from any of its obligations, including but not limited to, communications, Site updates, shipping and fulfillment, and any other service that may be provided by Us. This will last only as such event is reasonably inhibiting our responsibilities and we continue to take reasonable steps to mitigate the effect of the Force Majeure Event and to substantially perform despite the occurrence of the Force Majeure Event.

11. Disclaimer of Warranty / Limitation of Liability

UNLESS REQUIRED BY APPLICABLE LAW THE HOUSE OF RAIGE PROVIDES THIS SITE AND SERVICES ON AN “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. HOUSE OF RAIGE MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND CONTENT CONTAINED ON THE SITE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE HOUSE OF RAIGE LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSIQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF PERFORMANCE OF THE SITE OR RELATED SERVICES.
